TERMS AND CONDITIONS
1. Deposit, Payment of the Purchase Price, Fees
I, ____________________the Buyer, declare that all outstanding payments are paid in full. The Puppy/Dog was picked-up/dropped-off on, _________ _____, 20___ as arranged and mutually agreed upon at the location of, _______________________. The buyer acknowledges and agrees that He/She will forfeit the deposit and any rights to the Dog if:
(a) The buyer fails to complete the purchase of the Dog for any reason before or on the day of pickup/drop off of the pup.
(b) The buyer fails to pay the remaining balance in cash in accordance with the purchase price upon the day of the agreed delivery date. And or an e-transfer has not been received prior to the pickup date.
(c) Fails to show up for the arranged mentioned date & location. In either event, the Seller shall be free to sell the Dog to another party.
(d) If the Dog is unavailable due to sickness, death, or any other circumstance owing to the fault of the Seller, the Buyer’s deposit will, at the Buyer’s option, be refunded or transferred to the next litter of puppies.
~A boarding fee of $10 per day will be charged for each day the Dog is boarded by the Seller past the agreed delivery/pick-up date.
2. Seller’s Representations and Warranties
Seller represents and warrants to Buyer that:
(a) Seller is the legal and true owner of the Dog and the Seller has the full right and authority to sell the Dog to you, the Buyer.
(b) The Dog is being sold free and clear of any lien, security interest, charge, or other encumbrance.
(c) Seller confirms to her knowledge and integrity that the Puppy/Dog is of the American Cocker Spaniel purebred bloodline. The seller also states that the Veterinarian visit is completed.
(d) The Dog is in good health and free of communicable diseases at the time of this sale. The buyer has 2 days from the delivery date to have the Dog examined by a licensed veterinarian, at Buyer’s sole cost. If the Dog fails the examination, the Buyer may return the Dog, with a written statement from the veterinarian, for a full refund. Failure by the Buyer to have the Dog examined within the 2-day period will nullify this warranty. If the Buyer chooses to keep the puppy, no replacement will be given and all medical costs and treatment are the sole responsibility of the Buyer. This health guarantee will be null and void.
(e) The buyer agrees that they have thoroughly researched the American Cocker Spaniel and viewed the “Disclosure” on the Seller’s webpage and thus understand the common health problems associated with this breed. Therefore, there is no guarantee for the perfect health of the dog over the course of its life. The Seller will NOT replace a puppy or offer a refund due to heatstroke, food allergies, poor nutrition, abuse/neglect, or improper socialization. The buyer is responsible for all the medical costs of their puppy from the day of pickup/drop off.
3. Fitness of Purpose
The Dog is offered as a companion animal, thus the Seller does not provide any warranty as to the Dog’s fitness for any specific purpose, including obedience trials, show ring performance, and/or breeding purposes.
4. Buyer’s breeding agreement.
It was understood by "Pam's American Cocker Spaniels" that the purchase of the Puppy was for companionship and was not intended for breeding. But, if the dog is used for breeding at any point in His or Her life and results in monetary profit, the Buyer agrees to pay an additional fee of $500 to the seller, Pam Mast, within 12 weeks of the first litter's delivery date. (Thus, before pups turn 12 weeks old) They also agree to share photos and thoughtful details of the grand puppies with the Seller. If the intention was to breed the dog originally, or the dog becomes pregnant in her lifetime the buyer is aware and agrees that the additional cost of $500 is to be paid in full upon the pick-up date or before the first litter is 2 weeks old. (Also includes males for breeding) If the dog is sold, given, or borrowed to another party/owner, he or she agrees to follow through with this given contract.
Either way; the Seller desires to keep in touch with the Buyer, at the option of the Buyer. A 1-year-old weight of the pup is appreciated. Pictures are always appreciated. Thank you :)
By signing this contract you agree to allow pictures on seller’s website; unless otherwise stated by the seller.
5. Entire Agreement
This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations, or warranties, express or implied, unless specifically stated in this Agreement.
